Terms and Conditions

LUMINET is a 100% subsidiary of the CRISP S.A. company, whose registered office is located in Zone Franka Saret, District of Rio Segundo, Canton the Alajuela, Province of Alajuela in Costa Rica, with legal Cedula 3-101-525 475. CRISP facilitates it's daugther companies LUMINET , TICOPLAZA and TUCANNEWS, with network access, internet access and all other necessary equipment and services. CRISP is legal responsible for all activities from LUMINET unless otherwise has been agreed upon.

First .- The use of the networks or any other offered related service, offered or supplied by LUMINET or it's parental company are charged, if applicable, in US dollars or in the exchange rate of the particular affected month in colones. Notwithstanding that this may vary, according to the tenth clause of these Conditions. Some of the services offered require prior user registration, the use of which must register as a customer of LUMINET or it's parental company.

Second. All services rendered by LUMINET are facilitated and under the legal umbrella of CRISP. CRISP is the official legal entity and owns all necessary legal authority's to supply and offer Internet services in the entire geografical teritory of the Costarican Republic, under the SUTEL authorization of TH-038 provided in 2009. This document is available upon written request and might be provided by CRISP management upon their judgement.

Third - The use of the LUMINET network and other internet services or any of the service owned by Luminet or it's parental company, expresses fully acceptance of the terms and conditions set out in this document.

Fourth .- The user(s) agrees not to use the LUMINET network and internet access services or any of the services offered by LUMINET or it's parental companies, for activities contrary to Costarican law, internet ethics, general accepted morals, nor to disturb public order.

Fifth .- LUMINET and it's parental company, acts exclusively as a service provider of communication between third parties, expressedly LUMINET nor it's parental company are being responsible for any content that the thrid parties may transmit.

Sixth .- The user is obliged to respect at all times, the restrictions on use of the services provided by LUMINET or it's parental company.

Seventh .- LUMINET nor it's parental company are responsible for any failures that may occure in communications, including deletions, transmission delays or incomplete transmissions. May disruption of the offered services occure, than solely the SLA ( Service Level Agreement) agreed rules and regulations are valid. If no SLA has been signed or agreed upon in a written manner, LUMINET nor it's parental company are responsible for any damage or any other consequential damage. Therefor LUMINET and it's parental company will deny all charges, other than agreed upon in the SLA signed by both parties and paid by the user(s).

CRISP has taken all the legal required security measures for the protection of personal data supplied or transmitted by the user or it's intended receiver(s). Our equipment is installed in a save, secured and qualified data centre in Costa Rica and Europe. However, LUMINET nor it's parental company, invulnerability can guarantee the absolute security of their systems, nor can it guarantee the safety or the data transmission through the network. LUMINET not it's parental company can guarantee the legality, reliability and usefulness of content that users transmit using the networks facilitated by CRISP S.A.. LUMINET nor it's parental company do control or guarantee the absence of viruses in the services provided by third parties through the provided access by LUMINET that may cause alterations in its computer system (software and hardware) or in the documents and electronic files stored on your computer system(s).

Eighth .- LUMINET or it's parental company has always the right to maintain their network. In all times LUMINET or it's parental company will inform it's users ( customers) before hand in a appropriate timely matter.

Ninth .- LUMINET reserves the right to unilaterally modify at any time, or introduce new conditions to the general terms and conditions. It is LUMINET'; responsibility to always display the relevant terms and conditions online. Customer or users of the CRISP network are to be expected to be aware of the LUMINET and her parental company's general rules and regulations and all her recent alterations.

Tenth.- LUMINET waives all responsibilties of damage and or consequential damage casued by Act of God, like floods, earthquackes, winds, lightning or any other cause not be controlled by human actions.

Eleventh .- The providing parties, expressitly waive their own jurisdiction, as accepted in the Costarican law governing this contract, and are subject to the resolution of all disputes arising out of the same Courts of San José, Costa Rica.
